Welcome to Mattress Carnival. These Terms of Service govern your use of our website, your purchases from Mattress Carnival, and your interaction with our products, services, promotions, delivery options, sleep trial, financing options, and customer support.
By visiting our website, placing an order, purchasing from our store, scheduling delivery, requesting a comfort exchange, or using any of our services, you agree to these Terms of Service.
1. About Mattress Carnival
Mattress Carnival is an affordable local mattress store located in Smyrna, Tennessee. We sell mattresses, bedding products, mattress protectors, pillows, adjustable bases, foundations, bed frames, and related sleep products through our physical store and online Shopify store.
2. Website Use
You may use our website for lawful shopping, browsing, product research, order placement, and communication with Mattress Carnival.
You agree not to misuse our website, submit false information, interfere with website security, attempt unauthorized access, copy our content without permission, abuse promotions, or use our website for fraudulent or unlawful purposes.
3. Product Information
We make reasonable efforts to display accurate product names, descriptions, prices, sizes, comfort levels, colors, materials, images, promotions, and availability.
However, product images and descriptions may vary slightly from the actual product due to screen settings, lighting, manufacturer updates, fabric changes, photography, or model changes.
Comfort descriptions such as “soft,” “medium,” “firm,” “cooling,” “supportive,” or “pressure relieving” are general descriptions only. Mattress comfort may feel different depending on body weight, sleep position, room temperature, foundation, and personal preference.
4. Pricing and Availability
Prices, promotions, discounts, bundles, financing offers, and availability may change at any time without notice.
We reserve the right to correct pricing errors, product listing errors, typographical errors, inventory errors, or checkout errors. If an order is affected by an error, we may cancel the order, issue a refund, or offer the correct price.
A product shown online may not always be immediately available. Some products may be in stock, while others may require special order or supplier availability.
5. Orders and Acceptance
Placing an order does not automatically mean the order has been accepted. Mattress Carnival reserves the right to refuse, cancel, or limit any order for reasons including payment issues, suspected fraud, incorrect pricing, inventory problems, delivery limitations, misuse of promotions, or other business reasons.
6. Payment
Payment must be completed before products are released for delivery or pickup unless Mattress Carnival has approved another arrangement in writing.
We may accept payment methods shown at checkout or available in-store. Payment processing may be handled by Shopify, card processors, financing providers, or other third-party payment services.
7. Financing
Mattress Carnival may offer financing through third-party financing providers. Financing approval, interest rates, payment terms, credit limits, fees, and repayment schedules are controlled by the financing provider, not Mattress Carnival.
Customers are responsible for reviewing and understanding all financing terms before completing a purchase.
8. Sales Tax
Applicable sales tax will be calculated and charged according to Tennessee law and any other applicable tax rules.
9. Delivery and Pickup
Mattress Carnival may offer local delivery, white glove delivery, and customer pickup depending on product type, location, and availability.
White glove delivery is available for $149. White glove delivery may include delivery of the product to the customer’s home and placement in the selected room, where applicable.
Customers are responsible for making sure the delivery path is clear and safe. This includes measuring doorways, hallways, stairways, elevators, and room space before delivery.
An adult 18 years or older must be present at the delivery address during the scheduled delivery time.
Mattress Carnival does not currently offer old mattress removal. Customers are responsible for arranging removal or disposal of old mattresses, foundations, bedding, or furniture.
10. Customer Pickup
Some products may be available for customer pickup. Customers are responsible for bringing a suitable vehicle, tie-downs, and enough help to safely load and transport the product.
Once a product leaves Mattress Carnival with the customer, Mattress Carnival is not responsible for damage caused during loading, transportation, unloading, storage, or setup.
11. Returns and Refunds
Mattress sales are generally final once the mattress has been delivered, picked up, opened, used, or removed from original packaging.
Eligible mattresses may qualify for a one-time comfort exchange under our Sleep Trial Policy.
Bedding items are final sale and cannot be returned, refunded, or exchanged. This includes pillows, sheets, mattress protectors, mattress toppers, blankets, comforters, and other bedding accessories.
Clearance items, floor models, final sale items, as-is items, special-order items, and heavily discounted items are not eligible for return, refund, or comfort exchange unless Mattress Carnival approves otherwise in writing.
12. Sleep Trial and Comfort Exchange
Eligible mattresses may include a 90-day sleep trial.
To qualify for the sleep trial, the customer must purchase a mattress protector with the mattress and must keep the mattress in like-new condition.
The mattress must have no stains, odors, rips, tears, moisture, smoke smell, pet damage, bed bugs, mold, burns, cuts, or other damage.
The sleep trial allows a one-time comfort exchange only. It is not a cash refund program.
The replacement mattress must be of equal or greater value. If the replacement mattress costs more, the customer must pay the difference.
Approved comfort exchanges are subject to a 10% restocking fee and a $50 pickup and inspection fee.
Customers may not bring the mattress back to the store themselves. Mattress Carnival must pick up and inspect the mattress to determine whether it qualifies for comfort exchange.
13. Warranty
Manufacturer warranties vary by brand and product. Mattress Carnival may assist customers with warranty information, but warranty approval, denial, repair, replacement, or remedy is controlled by the manufacturer unless stated otherwise in writing.
Warranty claims usually require proof of purchase, product photos, law tag photos, and photos of the foundation or support system.
Warranty coverage may be denied if the product is stained, damaged, unsanitary, used with improper support, abused, altered, or used incorrectly.
14. Customer Responsibilities
Customers are responsible for choosing the correct mattress size, comfort level, foundation, frame, and delivery option.
Customers should measure their room, doorway, hallway, staircase, elevator, and bed frame before purchasing.
Mattress Carnival is not responsible if a product does not fit due to incorrect measurements, blocked access, limited space, or customer error.
15. Promotions and Discounts
Promotions, coupons, bundles, sale prices, financing offers, and discounts are available only during the advertised period and while supplies last.
Unless stated otherwise, offers cannot be combined.
Mattress Carnival reserves the right to modify, cancel, or correct promotions at any time.
16. No Medical Advice
Mattress Carnival may provide general sleep-product guidance, but we do not provide medical advice.
Statements about support, comfort, cooling, pressure relief, or sleep quality are general retail guidance only and are not medical claims.
Customers with medical conditions, back pain, allergies, orthopedic concerns, or sleep disorders should consult a qualified healthcare professional.
17. Third-Party Services
Our website may use third-party services such as Shopify, payment processors, financing providers, advertising platforms, delivery providers, email services, SMS services, and analytics tools.
Mattress Carnival is not responsible for the terms, privacy practices, approval decisions, technical issues, or service failures of third-party providers.
18. Intellectual Property
All website content, including text, images, logos, banners, product descriptions, graphics, layout, and design elements, belongs to Mattress Carnival or its content providers unless otherwise stated.
You may not copy, reproduce, distribute, modify, or commercially use our content without written permission.
19. Limitation of Liability
To the fullest extent permitted by law, Mattress Carnival is not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages related to website use, product purchases, delivery delays, product availability, comfort preference, third-party services, or use of our products.
Our total liability for any claim related to a purchase will not exceed the amount paid for the specific product or service involved in the claim.
20. Policy Updates
Mattress Carnival may update these Terms of Service at any time. Updates will be posted on this page with a revised effective date.
Continued use of our website or services after updates means you accept the revised Terms.
